Terms of Service
These Terms govern your use of the MediaClip website (mediaclip.net) and the MediaClip media intelligence service. By using our website or requesting a demonstration, you agree to these Terms. Enterprise clients are covered by a separate signed service agreement which prevails to the extent of any conflict with these Terms.
1. The service
MediaClip provides media monitoring and intelligence for Botswana print, radio, television, digital news and public social conversations. Coverage varies by public availability, licensing terms and third-party platform API policies. Specific outlets, update frequency and delivery are confirmed with each client during onboarding.
2. Website use
Content on mediaclip.net is provided for information about our service. You may not:
- Use the website in a way that violates applicable law.
- Attempt to gain unauthorised access, interfere with, or disrupt any part of the website or its underlying systems.
- Reproduce, distribute or create derivative works from our content without our written permission.
3. Demo requests and the five-day brand snapshot
Where we offer a free five-day brand snapshot, it is provided as a limited operational trial for evaluation purposes. Delivery and content are subject to source availability and analyst capacity. Snapshot data is not a commercial deliverable and is provided without warranty.
4. Intellectual property
The MediaClip name, logo, Signal Engine methodology, dashboards, reports and website content are the property of MediaClip and its owners. Client dashboards and reports produced under a signed service agreement are licensed to that client for internal business use unless otherwise agreed.
5. Third-party content
MediaClip monitors publicly available media coverage. Copyright in the underlying works remains with the original publishers and rights-holders. Client access to media clippings is provided in line with fair-use principles and applicable licensing terms. Onward publication of monitored content by clients is their responsibility.
6. Availability and support
We aim to keep the MediaClip service available on a continuous basis but do not warrant that it will be uninterrupted or error-free. Enterprise service levels, support hours and response times are set out in each client's service agreement.
7. Warranties and liability
The website and any information provided outside a signed service agreement are supplied on an "as is" basis without warranties of any kind, express or implied. To the extent permitted by Botswana law, MediaClip is not liable for indirect, incidental or consequential loss arising from use of the website. Nothing in these Terms limits liability that cannot lawfully be limited.
8. Governing law
These Terms are governed by the laws of the Republic of Botswana. The courts of Botswana have exclusive jurisdiction over any dispute arising from these Terms or the use of the website.
9. Changes
We may update these Terms as the service or the law changes. The effective date at the top of this page reflects the current version.
